PURCHASE CONDITIONS FOR WINE TOURISM EXPERIENCES
These Purchase Terms and Conditions shall apply to all purchases of wine tourism experiences offered through the website www.emiliomoro.com and together with the offer, price and description of the same set out on the website, and, where appropriate, the specific conditions of the same set out in this document, shall govern the legal relationship between Bodegas Emilio Moro, S.L., (hereinafter EMILIO MORO) and the user, making up the entire agreement between EMILIO MORO and the user.
The period of validity of these Purchase Conditions shall be the period of time they remain published on the website, and shall refer to the purchase of Products at the time these conditions are available.
Acceptance of these Purchase Conditions by the user shall be an essential requirement in order to formalise any contractual relationship between the user and EMILIO MORO.
We are sorry, but we can only accept requests to purchase experiences from persons of legal age. If you are a minor, you must inform your parents or guardians of these Purchase Conditions. Your parent or guardian must indicate their acceptance of these terms and conditions before using this website or making any purchase from this website.
Identification of the parties
On the one side, BODEGAS EMILIO MORO, S.L., owner of the website www.emiliomoro.es (hereinafter ‘Website’), a company incorporated under Spanish law, with tax identification number B47359492, with registered offices at Ctra. Peñafiel-Valoria s/n, Pesquera de Duero (Valladolid), telephone 983 87 84 00, and registered in the Commercial Register of Valladolid in Volume 592, Folio 143, Page VA-6402, 1st entry.
On the other side, the user, of legal age, whose details have been entered by him/her in the corresponding forms. All the data included in these forms have been entered directly by the user, so that the responsibility for the authenticity of the same corresponds directly and exclusively to the user.
Purpose of the agreement
By accepting these Conditions, EMILIO MORO undertakes to make the experiences purchased through the Website available to the user and the user undertakes to pay the price indicated at the time of purchase.
Registration process
To purchase the Experiences offered by EMILIO MORO through the Website, you must register. The user can register at any time before or during the purchase process.
In relation to the registration process, the user is solely responsible for the quality of the data entered by him/her in the forms, and accepts the obligation to provide true, accurate and complete data on his/her identity, as requested in the registration, purchase and accreditation forms, as well as to update all registration data so that they remain true, accurate and complete.
The user may at any time modify and/or update their data by accessing their User profile within the portal, but we recommend that they always confirm that the data entered and/or modified are correct, especially their e-mail address and delivery address for orders, in order to avoid future problems.
In order to register you must be of legal age in accordance with Spanish law, and you may be a resident of any country in the world.
Once the user has entered their details and clicked on the registration button, we will send them a confirmation e-mail in order to authenticate the data provided during registration. The sending and receipt of this email is usually automatic and in any case within 24 hours of sending the registration request. If the user has not received it within this period of time, it may be due to a specific failure of communications or an error in the e-mail address provided. In both cases, the user should contact us as soon as possible by e-mail at tiendaonline@emiliomoro.com.
If the user provides any false, inaccurate or incomplete information, or if EMILIO MORO has sufficient reason to suspect that such information is false, inaccurate or incomplete, it shall be entitled to deny access and present or future use of the website or any of the services.

Experiences
All the information on the Wine Tourism Experiences offered by EMILIO MORO, including but not limited to prices, characteristics, description, content, etc., is available to the user on the website and will appear on screen in each case.
We try to make the descriptions of the Experiences that the user can view by accessing each of them as accurate and useful as possible, but we cannot guarantee that they are error-free. EMILIO MORO will do everything in its power to detect and correct any inaccuracies or errors that may appear.
Confirmation and purchase system
In order to purchase the Experiences offered through the Website, it is necessary to accept the privacy policy, the present Purchase Conditions and the declaration of being of legal age.
Remember that personal data must be indicated with complete accuracy to avoid confusion or problems in the provision of the Service.
The experiences to be purchased must be selected, the user must fill in the corresponding purchase form that will appear on the screen, together with a summary identifying the selected Experience, its total price, the applicable taxes and click on the corresponding icon.
The verification of such data shall be the sole and exclusive responsibility of the user. EMILIO MORO shall not be liable to the user for any errors or inaccuracies in the purchase if the purchase has already been accepted.
If the user provides any false, inaccurate or incomplete information, or if EMILIO MORO has sufficient reason to suspect that such information is false, inaccurate or incomplete, it reserves the right to cancel the CUSTOMER’s purchase. In such a case, EMILIO MORO will inform the user and will proceed to refund the amounts paid, discounting the expenses generated by the transaction, through the same means by which the payment was made, within fourteen (14) days following said communication.
Once the purchase form has been completed, the user must accept these Purchase Conditions and confirm that he/she is of legal age. Once accepted, the user will be redirected to an on-line payment platform where he/she can finalise the purchase using any of the accepted payment systems.
Once the transaction has been confirmed, the user will receive an e-mail with the purchase information, and a ‘visitor’s guide’ will be sent with general information about the visit.
This communication shall detail the system for requesting the delivery of the corresponding electronic invoice. The non-receipt of this message may be due to a transitory problem of communications on the network or a typing error in the e-mail address communicated. In both cases, it is advisable to contact customer service at the following e-mail address enoturismo@emiliomoro.com
It is also advisable that you check the data included in the e-mail and, if you detect any error, contact customer service at enoturismo@emiliomoro.com.
Prices
The characteristics and prices of the Experiences are indicated on screen in euros and include VAT and will at all times be those in force, except in the case of typographical errors. Such taxes will be included in the invoice with an itemised breakdown. In general, 21% for experiences and shop – 10% for wine bar and restaurant.
The prices shown on the website override all previously published prices and are valid at the time of publication. EMILIO MORO undertakes to make every effort to maintain these prices, although it reserves the right to modify them without prior notice. Price changes will not affect orders already placed.
Payment methods and security
EMILIO MORO accepts requests to purchase experiences at any time, 24 hours a day, every day of the week. For purchases of experiences made on the same day, we recommend that they are confirmed by telephone at 983 878 400.
EMILIO MORO offers you different payment methods so that you can choose the one that best suits your needs:
- Credit card: You can pay for your purchases with Visa and Mastercard credit cards. When paying by credit card, your purchase will be processed through a payment gateway (secure server) of HPP Realex / La Caixa, to ensure total security and privacy of your data. You must confirm that the credit card you are using is yours or that the cardholder has authorised you to use it. Credit card holders are subject to validation and authorisation checks by their card issuer. If your card issuer refuses to authorise payment to EMILIO MORO, we cannot be held responsible for any delay in delivery.
- PayPal: For payments made through PayPal, we will redirect you to the appropriate page so that you can log in and pay through PayPal’s secure services. The use of these services may entail additional costs due to the commissions applied by PayPal, which you will have to pay. These costs will be indicated in each case, and always before proceeding to confirm the purchase.
EMILIO MORO reserves the right to withhold any order for security reasons and to temporarily deny access to the Experiences purchased. The affected users will be informed. Likewise, EMILIO MORO reserves the right to cancel a purchase if it considers that the data provided by the user cannot be verified, or if it considers that the Experience has been acquired by the user for resale.
We will, to the extent that we are entitled to do so, keep your order and payment details secure; however, in the absence of negligence on our part we cannot be held responsible for any loss you may suffer if a third party attempts to gain unauthorised access to the information you provide when accessing this Website or ordering from this Website.
EMILIO MORO shall not be held responsible for problems arising from the lack of authorisation by the payment system.
Changes and cancellations
If you wish to change or cancel your purchase, you can contact us by email at enoturismo@emiliomoro.com or by telephone 983 878 400 during customer service hours: Monday to Sunday from 10 am to 6 pm.
To change the purchase of an Experience, the purchase will be cancelled and EMILIO MORO will refund the price paid and the user will have to make a new purchase of the selected experience. Once we have received the modification request and checked availability, a confirmation of purchase will be sent.
You can cancel your visit, free of charge, up to 48 hours before your visit. For cancellations made at shorter notice, the company reserves the right to charge the full amount of the experience.
All refunds will be made in the same payment method as the original purchase. EMILIO MORO will process the price refund order using the same payment system used by the user during the experience purchase process, within a maximum period of 7 days from acceptance of the order. The arrival of the price refund into the user’s account will depend on their banking institution.
If, due to force majeure, the winery is forced to cancel your reservation, we will arrange for you to visit another winery in the Ribera de Duero region. Once our facilities are open again, we will get in touch with you to let you know.
General rules and guidelines for wine tourism experiences
- Opening hours: Visits are scheduled to begin at a specific time. Please be punctual and arrive at the winery five minutes before your reservation time. In case of delay, the user can join the group at the point of the visit where he/she is. EMILIO MORO reserves the right to cancel the visit if the user arrives more than 45 minutes late, and will not refund the price of the experience, except in circumstances of force majeure.
- Location of the visit: The winery reserves the right to change the activity due to availability or weather conditions. In addition, if, due to exceptional circumstances, the weather does not allow it, the visit to the vineyards may be modified, in which case the same explanations will be given inside the winery. In addition, during the grape harvest period, the route of the visits will be modified due to the restriction of access to certain production areas.
Visits involving travel will be made in the vehicle provided by EMILIO MORO for this purpose.
- Allergies and intolerances: Users must inform EMILIO MORO of any food allergy or intolerance. EMILIO MORO cannot be held responsible for any problems arising from these if it has not been informed of them.
- The use of a mask is recommended in case of symptoms of contagious disease.
- We have an outdoor car park next to the entrance to the winery, two spaces with a charging point for electric cars and another space for people with reduced mobility (PRM).
- In the event that the visit is to be made by a person with reduced mobility, we recommend that you notify our wine tourism department by sending an email to enoturismo@emiliomoro.com or contacting us by telephone on 983 878 400, so that we can adapt the visit to your personal circumstances.
- Minors must be accompanied by an adult.
- Pets are not allowed on the premises except guide/service dogs.
Rules and restrictions during the visit
- The visit begins at reception, where you must register by filling in an access form using a QR code. You are required to confirm that you have read and understood the rules for access to the wine cellar. A wine tourism expert will guide you throughout the visit. Please follow their instructions and remain with the group.
- Please follow these rules in the wine-production areas:
- Respect work zones. Try not to distract or photograph personnel. They are just doing their job.
- For your own safety, do not touch machinery or exposed parts.
- If necessary, you will be given the appropriate protective clothing to access each area.
- It is PROHIBITED:
- Bringing and/or consuming food in the production area.
- In compliance with the Anti-smoking Law, smoking is not permitted on our premises, except in the areas designated for this purpose.
- You may take photographs as long as they are not of workers or visitors without their prior consent. It is NOT permitted to record the visit in image or sound.
EMILIO MORO reserves the right to terminate the visit and remove users who breach these rules or endanger the integrity and/or safety of themselves, other users or EMILIO MORO employees.

Modification of the Conditions
EMILIO MORO reserves the right to modify this agreement, when it deems it appropriate or in order to adapt these texts to legislative or technological changes or to its contractual relationship with third parties. The user will be duly informed of such modifications.
Partial invalidity
If any part of these Conditions is unlawful and therefore invalid, this shall not affect the other lawful provisions. The parties undertake to renegotiate those parts of the contracting conditions that are invalid and to incorporate them into the rest of the contracting conditions.
Applicable law and dispute resolution
These Purchase Conditions shall be governed by and construed in accordance with Spanish law. The Parties agree to settle any discrepancy or conflict out of court and only in the event that this is not possible will the parties submit to the Courts and Tribunals that correspond by law. In the event that the User is considered a consumer and user, the Courts and Tribunals of the User’s domicile will be competent to hear any discrepancy.
In this case, we inform you that, as a consumer and user, you have the right to request an out-of-court resolution of consumer disputes through the online dispute resolution platform developed by the European Commission, accessible through the Internet address http://ec.europa.eu/consumers/odr/.
